Terms of Service
1. The Service
Pro Site Link is a web app for service businesses to write estimates, schedule work, invoice customers, track jobs, and understand overhead and profit (the "Service"). You can use it on one device without an account, or with a company cloud account that syncs across devices and lets you add your team.
2. Accounts
- You must be at least 18 and able to form a binding contract. The Service is for business use.
- Give accurate information and keep it up to date. Keep your password private and tell us right away at [contact email] if you suspect unauthorized access.
- The company owner controls the company account, decides who has access and what each person can do, and is responsible for activity under the company's account.
3. Free trial, plans and payment
New company accounts start with a 30-day free trial. Paid plans renew automatically for the period you choose until you cancel, as explained in our Billing and Cancellation Policy, which is part of these Terms. We will never charge you for a paid plan unless you have chosen it and agreed to its renewal terms, and you can cancel online at any time.
4. Your data
- You own your data. Your company keeps all rights to the records, files and content you put into the Service ("Customer Data").
- You give us permission to host, copy, process and display Customer Data only to provide, secure and support the Service, and as described in our Data Processing Addendum, which is part of these Terms for business customers.
- You are responsible for having the rights and permissions needed to store your customers', crew's and suppliers' information, for giving them any required notices, and for following the laws that apply to your business.
- You can export your records at any time with Backup and restore and the export options in the App.
5. Acceptable use
You agree not to:
- break the law, infringe others' rights, or store content you do not have the right to store;
- send spam or unlawful messages using information from the Service;
- try to access another company's data, probe or bypass security, or share sign-ins;
- overload or disrupt the Service, or use bots to scrape it;
- copy, resell, reverse engineer or build a competing product from the Service, except where the law allows; or
- upload malware or harmful code.
6. Third-party services
Some features rely on other providers, such as address suggestions, payment processing and the PDF preview tool. Their use is subject to their own terms. We are not responsible for services we do not control.
7. Our property and feedback
The Service, its software, design and content (other than Customer Data) belong to Pro Site Link and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send ideas or feedback, we may use them without any obligation to you.
8. Changes and availability
We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may add, change or remove features. If a change removes something important from your paid plan, we will tell you in advance and you may cancel. New features may be labeled beta and may change or end.
9. Your calculations and documents
The Service helps you calculate prices, taxes, overhead, profit and invoices, but you are responsible for checking every estimate, invoice, tax amount and report before you rely on it or send it. The Service does not provide tax, legal, accounting or financial advice.
10. Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent the law allows, Pro Site Link will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if you have not paid us. Some places do not allow these limits, so they may not apply to you.
12. Indemnity
If you use the Service for a business, you agree to defend and hold Pro Site Link harmless from claims arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of law or others' rights.
13. Ending the agreement
You can stop using the Service and cancel at any time. We may suspend or end access if you seriously or repeatedly break these Terms, if required by law, or to protect the Service or others. For other reasons, we will give at least 30 days' notice. Whenever possible, we will give you a chance to download your records first. Sections that by their nature should survive, such as ownership, disclaimers, limits of liability and disputes, continue after the agreement ends.
14. Disputes
Please contact us first at [contact email]; most issues can be solved quickly. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be decided in the state or federal courts located in Los Angeles County, California, and both parties consent to those courts, except that either party may bring a claim in small claims court if it qualifies.
15. Changes to these Terms
We may update these Terms. For material changes, we will notify you in the App or by email at least 30 days before they take effect. If you keep using the Service after that, the new Terms apply. If you do not agree, you may cancel before they take effect.
16. General
These Terms, together with the policies they link to, are the entire agreement about the Service. If any part is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. Neither party is responsible for delays caused by events beyond its reasonable control.
